General

The General Data Protection Regulation (GDPR) applies throughout the European Union, and its purpose is to create a uniform and harmonised level for the protection of personal data. Like other Privacy Regulations, the GDPR exists to protect individuals' fundamental rights and freedoms, in particular their right to protection of their personal data.

As part of the business of NUITEQ, NUITEQ will from time to time collect and process information, by which individuals can be identified (“Personal Data”). NUITEQ will fully comply with GDPR as well as applicable local privacy regulations in NUITEQ’s targeted markets, and is committed to privacy and will only process information in accordance with this policy.

The purpose of this Privacy Policy is, therefore, to inform individuals how NUITEQ uses, processes, collects and shares Personal Data within the company. This Privacy Policy sets out how NUITEQ, including all its subsidiaries and branches, complies with the GDPR and other applicable privacy regulation requirements.

This Privacy Policy applies to all of NUITEQ’s websites and interactions and are divided into Education related services including but not limited to NUITEQ Snowflake, and Non-Education related services including but not limited to NUITEQ Stage. NUITEQ Services refers to both Education and Non-Education related services and websites.

Transfer of Personal Data outside of the EU/EEA area

By using the NUITEQ Services, You, the Individual that uses NUITEQ’s Services, consent to the transfer of Your personal data to the UK where NUITEQ’s servers are located. Users of NUITEQ’s Non-Education Services also consent to the transfer of Your data to the USA, for the purpose of allowing NUITEQ to use the statistical service Google Analytics, and relationship management tool HubSpot.

Security

NUITEQ is committed to ensuring that Personal Data is secure. NUITEQ has therefore implemented appropriate technical and organisational measures to be able to demonstrate that the processing is performed in accordance with the GDPR and other applicable privacy regulations. To prevent unauthorised access or disclosure, NUITEQ has put in place appropriate physical, electronic and managerial procedures to safeguard and secure the Personal Data collected.

Users’ account information is password-protected. NUITEQ Services shall safeguard the security of data provided by Users with physical, electronic, and managerial procedures. In certain areas of our websites, NUITEQ uses industry-standard SSL-encryption to enhance the security of sensitive data transmissions. However, NUITEQ cannot ensure the complete security of the information transmitted by Users.

NUITEQ’s Education Services offer a variety of ways to protect the privacy of students, this includes the creation of non-identifiable accounts that do not have an email address. We also support single sign on using trusted providers. NUITEQ’s technical measures to demonstrate data security is described in the documentation page at https://docs.nuiteq.com/.

We regularly monitor our systems for signs of a breach. In the event of a breach or incident, all users will be notified within the system and NUITEQ will also announce a breach to any IT and administrators who don’t have a NUITEQ account but have signed up for breach notifications at https://www.nuiteq.com/breachnotifications.

What Personal Data NUITEQ collects

NUITEQ Non-Education Services collect information such as the name, company, title and email addresses of Individuals who use services or engage with NUITEQ, and Individuals engaged in, or use, services offered by NUITEQ. From individuals seeking employment with NUITEQ within EU/EES, NUITEQ collects information such as the name, telephone, email address and CV including employment history and information.

NUITEQ’s Education Services are designed to support kindergarten, primary, and secondary students. With consent, data can be collected from students of age 13 years or younger. Consent will be tailored for each target market in compliance with local laws and regulations (including consent from the child and/or legal guardians). Educators can also use approved single sign on methods, or use select no-email to create a non-identifiable account.

In dealing with different Individuals for Non-Education related events, training and conferences, NUITEQ also obtains information about the business contacts, including name, title, full address, telephone, fax number, date of arrival, food preferences and allergies, copy of passport and/or passport number, citizenship (when a welcome letter for the visa application is needed), clothing size (clothing size only very rarely when branded clothing are being handed out), and email address.

In certain situations for NUITEQ Non-Education services, e.g. to provide services to employees or business contacts, both in foreign and home offices, or to our recruiting candidates, we will collect other data, including birth date and birthplace, gender, education, occupation, employment history and information, information about activities, citizenship, visa information, identification numbers, financial situation, account numbers, family information, banking details, compensation and payroll information, leave of absence information, dependents or beneficiaries (including name, address, email and phone), emergency contacts, background check information, food preferences and allergies and health information.

Data provided by Individuals is only collected and processed if required to meet legal obligations, fulfill agreements, or fulfill legitimate interest requests to handle data or if the Individual explicitly has given their consent to a specific use of their data.

NUITEQ’s Service data is only for the purpose of delivering the product or service requested. This means that NUITEQ’s Educational Service data is used for Educational purposes only.

We will always provide information on how data will be used at the point of capture or by other means if the data is provided by third parties.

NUITEQ’s Non-Education websites use cookies and other online tracking technologies that collect information about the use of services (collectively referred to in this policy as “cookies”). NUITEQ’s use and sharing of personal data collected

NUITEQ may use collected Personal Data for the following purposes:

  • To improve products and services such as crash reports, website improvements.
  • To offer or provide NUITEQ’s Services, such as a learning activity.
  • To monitor and manage agents and other service providers, including processing payments, accounting for Non-Education Services
  • Internal record-keeping and service monitoring.
  • To offer training and provide system notifications.
  • When a User has expressed his or her consent to share such information.
  • If sharing such information is necessary to provide a product or Service requested by a User. See our Third Party section.
  • NUITEQ may also disclose Users’ personal information if required to do so by law, to enforce NUITEQ’s Terms of Use, or in urgent circumstances, to protect personal safety, the public or the Site.

NUITEQ will not sell or lease Individuals’ Personal Data to third parties

For the purposes listed above, NUITEQ may share Personal Data with authorised vendors or agents responsible for delivering the NUITEQ Service requested. Some of these data processors may be based outside of the European Economic Area.

NUITEQ will not sell, lease or share personal data for third parties’ use, sharing is only done for NUITEQ’s own processing of personal data to provide the requested NUITEQ Services.

The European Commission Standard Contractual Clauses (“Model Clauses”), governing the transfer of personal data to countries whose national laws do not provide an adequate level of data protection, has been ruled by the European Commission to offer sufficient safeguards for the protection of individuals’ privacy and fundamental rights and freedoms, including the ability to exercise those rights. Data processors to NUITEQ will be contractually committed to process information in accordance with the provisions of European data protection legislation, and the transfer will be made in accordance with written agreements in the form of the Model Clauses.

Rights to Update, Delete, or Request Personal Data

In accordance with GDPR and other applicable data protection laws, Individuals or Parents (Legal Guardians), IT, and Administrators with valid identification are entitled to exercise their privacy rights. Including but not limited to requesting details regarding the Personal Data that NUITEQ holds and/or processes about them as well as requesting their data to be deleted, transferred to a third party, and/or requesting incorrect or incomplete information to be corrected.

Changes to Privacy Policy

From time to time, NUITEQ may use Personal Data for new, unanticipated uses not previously disclosed in this policy. However, such new processing will always be compatible with the purpose for which the Personal Data was collected. If its practices regarding Personal Data change at some time in the future, NUITEQ will post the policy changes (https://www.nuiteq.com/privacy-policy) to notify Individuals of these changes and provide the ability to "opt-out" or unsubscribe from these new uses.
